Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Texas Home Service Alliance ("THSA," "we," "us," or "our"). They govern your use of the THSA website located at thsa.com and any related services, tools, and content (collectively, the "Service").

By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

THSA operates a private online directory of home service contractors operating in Texas. We provide homeowners with a searchable database of contractors, their contact information, trade specializations, and certification status. We also offer contractors the ability to register, claim, and enhance their listings through our verification and certification programs.

THSA is a private certification and directory service. We are not a government agency, licensing board, or regulatory authority. Our certification programs represent our own independent assessment of contractor credentials and do not constitute an official government endorsement or guarantee of contractor quality.

THSA makes reasonable efforts to ensure the accuracy of contractor listings; however, we do not guarantee the completeness, accuracy, or reliability of any listing. Listings may include businesses that have not been claimed or verified by the contractor themselves.

Homeowners are encouraged to independently verify contractor credentials, licensing, and insurance before hiring. Contacting the Texas Department of Licensing and Regulation (TDLR) or relevant trade boards is recommended for independent license verification.

If you believe a listing contains inaccurate information, please contact us and we will investigate promptly.

Contractors who register with THSA agree to provide accurate, complete, and current information about their business. You are responsible for maintaining the accuracy of your listing and notifying THSA promptly of any material changes to your credentials, licensing, or insurance status.

THSA reserves the right to verify, suspend, or remove any contractor listing at our discretion, including if we discover that information provided is false, misleading, or violates these Terms. Fees paid for certification are non-refundable once verification work has commenced.

The THSA "Certified Pro" and "Verified" designations are proprietary to THSA and may only be used in connection with your active THSA listing. Use of these designations after cancellation or removal from the program is prohibited.

You agree not to:

• Submit false, misleading, or defamatory content, reviews, or contractor reports
• Use the Service to solicit or spam other users or contractors
• Scrape, crawl, or systematically extract data from the Service without our permission
• Attempt to gain unauthorized access to any part of the Service
• Use the Service for any unlawful purpose or in violation of any applicable federal, state, or local law
• Impersonate any person or entity, or falsely claim an affiliation with any person or entity

All content on the THSA website - including text, graphics, logos, icons, images, and software - is the property of Texas Home Service Alliance or its content suppliers and is protected by applicable copyright, trademark, and other intellectual property laws.

You may view and print content from the Service for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, or publicly display any content without our prior written permission.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. THSA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

THSA MAKES NO WARRANTY AS TO THE QUALITY, RELIABILITY, SAFETY, OR SUITABILITY OF ANY CONTRACTOR LISTED IN THE DIRECTORY. YOUR DECISION TO HIRE A CONTRACTOR IS SOLELY YOUR OWN RESPONSIBILITY.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THSA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR WORK PERFORMED BY A CONTRACTOR FOUND THROUGH OUR DIRECTORY.

IN NO EVENT SHALL THSA'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO THSA IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas.

You agree that any cause of action arising out of or related to the Service must be commenced within one (1) year after the cause of action accrues, or such action is permanently barred.

THSA reserves the right to suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including for violations of these Terms. Upon termination, all licenses granted to you under these Terms immediately cease.

We may update these Terms from time to time. We will notify you of material changes by updating the "Effective Date" at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
